The City of Miami’s Building Efficiency 305 (BE305) program has officially moved from its grace periods into strict enforcement for 2026. Commercial property owners are facing hard deadlines to report annual energy and water usage through the ENERGY STAR Portfolio Manager.
The Enforcement Timeline
- The Deadline: Buildings above 100,000 square feet must submit their annual data by June 30th.
- The Retuning Mandate: Furthermore, these large-scale buildings (100,000 sq ft and larger) face their first mandatory “retuning” procedures in 2026.
The Cost of Non-Compliance
Owners who fail to comply or who submit incomplete data are subject to severe penalties. The city enforces fines of $1,000 per day for a first offense, escalating to $5,000 per day for repeat violations.
